COMPLAINT PROCEDURE

The Minnesota State College and Universities Board of Trustees’ 1B.1 Nondiscrimination in Employment and Education Opportunity Policy states: “No person shall be discriminated against in the terms and conditions of employment, personnel practices, or access to and participation in, programs, services, and activities with regard to race, sex, color, creed, religion, age, national origin, disability, marital status, status with regard to public assistance, sexual orientation, or membership or activity in a local commission as defined by law.” The Minnesota State Colleges and Universities Board of Trustees’ 1B.1.1 Report/Complaint of Discrimination/Harassment Procedure is available to all members of Southwest Minnesota State University.

In addition to the complaint procedures, some employees may have grievance procedures in accordance with their respective collective bargaining agreements and personnel plans. Complaints/grievances will be processed in accordance with appropriate policies, rules, and collective bargaining agreements/personnel plans.

Please see Appendix B for the Nondiscrimination Policy in Employment and Educational Opportunity: Racial Discrimination/Harassment, Sexual Discrimination/Harassment and Violence, Sexual Violence/Sexual Orientation Discrimination/Harassment and Disability Discrimination/Harassment Policy. Copies of the policy are available in the Human Resource/Affirmation Action Office, BA 268. The Nondiscrimination Policy may be downloaded on Southwest Minnesota State University’s Website at https://www.smsu.edu/administration/humanresources and link under “Policies and Procedures” and on Minnesota State System's web site at http://www.minnstate.edu/System/ and link under “Board Policies".

The procedural steps in filing a discrimination/harassment complaint are outlined in System Procedure 1B.1.1 for Board Policy 1B.1. This is attached as Appendix C. This policy can be obtained from Southwest Minnesota State University and Minnesota State System's Website or in the Human Resources/Affirmative Action Office, BA 268.
